What We Do: Post-Conviction Relief, Rule 32 & Appeals.

The Justice Project will examine claims of innocence or manifest injustice made by any Arizona inmate who cannot get legal representation and is serving a sentence on an Arizona conviction. Once you have completed the 3-step process (below), we may be able to provide post-conviction relief or assistance with Rule 32 and appeals.

Step 1
The first step toward post-conviction relief is to complete our questionnaire, which asks for information about the crime in question, the trial or plea, the sentence, and why you believe you’re either innocent or the victim of manifest injustice. You must also sign a form that authorizes Justice Project attorneys to speak with the previous attorneys involved in your case.

The Justice Project case evaluators determine the merit of legal issues for post-conviction relief, clemency, habeas corpus relief, Rule 32 and appeals and decide whether or not your case should be accepted. Because there are a limited number of volunteers, the process of deciding who qualifies could take six months or more.

Step 2
Questionnaires that pass the preliminary investigation then go through a Level 2 Review. This comprehensive examination takes about three or four months. A law school faculty coordinator and a volunteer lawyer lead a team of private investigators and law school students.

Step 3
This stage can include state court proceedings for post-conviction relief, federal court habeas corpus efforts, or proceedings before the Arizona Board of Executive Clemency. At present, and at any given time in the recent past, the Justice Project has had 20 or more cases in one or another of these forums.
